This agreement applies to every person ("the Client") who books a G2 or G lesson package, a lesson package with the road test car, or the BDE road test car offer with RightSite Driving School ("the School"). For Clients under 18, "the Client" includes the parent or guardian who signs below. By signing, the Client agrees to the following terms.

1. Packages and Prices

G2 lessons are $50 + HST per hour. G lessons are $50 + HST per hour. A road test package combines 1 to 5 lesson hours with the School's car for one road test appointment at the Collingwood DriveTest Centre, which is $149 + HST. The road test car at any other DriveTest centre is $220 + HST. The prices that apply are the ones shown on the School's website on the day the Client books.

Lesson packages are not part of the Beginner Driver Education (BDE) certificate program and do not qualify the Client for MTO certification, the reduced G2 waiting period, or BDE-related insurance discounts.

2. Payment

The package fee is due before the first lesson, unless the School agrees otherwise in writing. The road test car part of the package must be paid in full before test day. Payment is by Interac e-Transfer or another method the School accepts. If a balance is unpaid, the School may pause lessons and will not provide the road test car until the balance is cleared.

3. Cancellations and No-Shows

At least 48 hours' notice is required to cancel or move a lesson without charge. A lesson cancelled with less than 48 hours' notice, or a no-show, is charged at $27.50 + HST, or that amount is taken off the package. The instructor waits 15 minutes at the pickup address. After that, the lesson counts as a no-show. Lessons cancelled by the School for weather, vehicle, instructor, or safety reasons are never charged and will be rescheduled.

4. Road Test Car

The Client must book their own road test with DriveTest. Renting the School's car does not book a road test. The road test car includes pickup, a warm-up drive before the test, use of the School's vehicle for the test, and drop-off afterwards. It covers one road test appointment. A retest needs a new road test car booking at the regular price.

To cancel or move the road test car without charge, the Client must give at least 48 hours' notice. With less notice, or if the Client does not show up, half of the road test car fee is charged. If DriveTest cancels or reschedules the test (for example, an examiner shortage or a weather closure), there is no charge, and the booking is moved to the new date once the Client sends the School the DriveTest notice.

The Client must bring their own valid Ontario licence to the road test. The School may refuse to provide the car if it has not driven with the Client before and the Client cannot show basic control of the vehicle during the warm-up drive. In that case the road test car fee is refunded in full. The School does not guarantee that the Client will pass. The result is decided by the DriveTest examiner.

5. BDE Student Road Test Car Offer

Students enrolled in the School's Full BDE course can rent the road test car for the Collingwood DriveTest Centre for $100 flat, HST included (regular price $149 + HST). The offer applies only to RightSite BDE students, only at the Collingwood DriveTest Centre, and only to one road test appointment. Other test centres and later tests are charged at the regular price.

6. Client Requirements

The Client must hold and present a valid Ontario driver's licence (G1, G2, G, or equivalent) at every lesson and at the road test and comply with all licence conditions, including corrective lenses. The instructor may refuse or end a lesson, without refund, if the Client appears impaired by alcohol, drugs, or fatigue, is unwell, lacks a valid licence, or drives in a manner the instructor considers unsafe. A refused or ended lesson counts as a no-show.

7. Assumption of Risk

Driving instruction takes place in live traffic on public roads and carries inherent risks that cannot be eliminated even with careful instruction, including collision, personal injury, and property damage. The Client understands these risks and voluntarily accepts them by taking part in lessons.

8. Release and Waiver of Liability

To the maximum extent permitted by law, the Client releases the School, its owners, instructors, and staff from all claims, demands, and causes of action arising out of or connected with the Client's lessons — including claims alleging negligence on the part of the School — except claims arising from gross negligence or willful misconduct. This release does not apply to liability that cannot lawfully be excluded, and does not limit the statutory rights of a Client who is a minor or any rights under the Ontario Consumer Protection Act, 2002.

9. Indemnity

The Client (and, for Clients under 18, the signing parent or guardian personally) agrees to indemnify and hold harmless the School against claims, losses, fines, and expenses — including reasonable legal costs — brought by any third party and arising from the Client's breach of this agreement, violation of law, or failure to follow instructor direction during a lesson.

10. Traffic Violations and Vehicle Damage

The Client is responsible for fines, penalties, and demerit consequences arising from their own conduct during lessons. The Client is responsible for damage to the training vehicle caused by their deliberate, reckless, or grossly careless conduct, or by ignoring a clear instructor direction, up to the School's insurance deductible.

11. Limitation of Liability

To the maximum extent permitted by law, the School's total liability to the Client for any claim arising from this agreement is limited to the amount the Client paid for the lesson or lessons giving rise to the claim, and the School is not liable for indirect, incidental, or consequential losses, including missed road tests, travel costs, or lost income. The School is not liable for delays or cancellations caused by events beyond its reasonable control.

12. Collections

Unpaid balances may be referred to a licensed collection agency. The Client consents to the School sharing their name, contact information, and outstanding balance with that agency solely for debt recovery, in accordance with applicable privacy and consumer protection laws.

13. Refunds

Completed lessons are non-refundable. Unused lesson hours in a package are refundable, less a $25 administration fee. The road test car fee is refundable when the Client cancels with at least 48 hours' notice, or as described in the Road Test Car section. Nothing in this section limits rights that cannot be waived under the Ontario Consumer Protection Act, 2002.

14. Dashboard Cameras and Privacy

Training vehicles record video during lessons for the safety of Clients and instructors. Footage is reviewed only after a collision or complaint and may be provided to police, insurers, or a court where legally required. Personal information collected on this form is used to deliver lessons, process payments, and communicate with the Client, and is handled in accordance with the School's Privacy Policy, available from the Privacy Officer at rightsitedrivers@gmail.com.

15. General

This agreement is governed by the laws of Ontario. If any part of it is found unenforceable, the rest remains in effect. It is the entire agreement between the Client and the School for lesson packages and the road test car and replaces any earlier understanding. The Client confirms they have had the opportunity to read this agreement fully and to seek independent legal advice before signing. If the Client is under 18, a parent or guardian must sign and agrees to this agreement — including Sections 8 and 9 — on their own behalf and, to the extent permitted by law, on behalf of the minor.

We do not operate a driving school, classroom, or office in Collingwood, Stayner, or any other community. Students from Collingwood, Stayner, and surrounding areas are served by in-car lessons and road-test-day services delivered from our Wasaga Beach location. All classroom instruction is provided online.
